Alternative Dispute Resolution
Roberts & Stevens provides Alternative Dispute Resolution (ADR) both in and out of the court. In North Carolina, ADR is mandatory in some cases. We provide mediation and arbitration services, and several of our attorneys are Certified Mediators.
Types of Services
• Arbitration - Arbitration is
a method of dispute resolution out of
the court. The parties of a conflict agree to be bound by a decision
made by an arbiter, an independent third party or a panel of arbiters.
The decision of an arbitrator is as binding on the parties to the
arbitration as a court judgment, and it can be enforced by the courts,
if necessary.
• Mediation - Mediation is a
negotiation process, in which the mediator
helps the parties negotiate a mutually acceptable solution. The
disputes may involve states, organizations, communities, individuals or
other representatives with a vested interest in the outcome.
Mediators use appropriate techniques and/or skills to open and/or improve dialogue in a dispute, aiming to help the parties reach an agreement. The mediator is impartial. Disputants may use mediation in a variety of disputes, such as commercial, legal, diplomatic, workplace, and community.
