David Hawisher is a partner at Roberts & Stevens whose practice focuses on appeals, dispositive motions practice, and complex trial litigation, including commercial healthcare litigation, medical malpractice, and catastrophic personal injury. He has achieved excellent results for parties and amici in the Fourth Circuit, North Carolina’s Supreme Court and Court of Appeals, the Western and Eastern Districts of North Carolina, and the North Carolina Superior Court.
David is active in the North Carolina Bar Association’s appellate practice division and in the North Carolina Association of Defense Attorneys. He has presented continuing legal education about appellate litigation for both groups, and he regularly submits amicus briefs on behalf of the NCADA in North Carolina’s appellate courts.
Notable appellate decisions include Collar v. Fletcher Hospital (lead counsel, argued), which reversed an interlocutory denial of summary judgment to hold that class-action-like trusts subject their beneficiaries to collateral estoppel; Parkes v. Hermann (principal author of briefing), which rejected the “loss of chance” causation doctrine adopted by a majority of other states; and Hall v. Henderson County (lead counsel, argued), which reversed the Superior Court to uphold a charity’s right to use its property as a residential ministry.
